A&B HomeFix – Terms & Conditions (Toronto, Ontario)
These Terms & Conditions govern all quotes, work orders, service calls, installation, maintenance, renovation, and general contracting services provided by A&B HomeFix to residential and commercial customers and to general contractors/subcontractors we contract with. By accepting a quote, signing a work order, booking online, allowing us to begin work, or paying an invoice, you agree to these Terms.
Note: These Terms are written for a private‑sector contractor operating in Toronto, Ontario. They are intended to align with applicable Ontario and federal laws. They do not replace your legal rights.
1) Parties & scope

Customer means the property owner, tenant, landlord, property manager, or their authorized agent who engages our services.

GC/Trades Partner means a general contractor, subcontractor, or supplier that we contract with.

These Terms apply to: (a) time‑and‑materials service calls; (b) fixed‑price quotes; (c) projects delivered as a prime contractor or subcontractor; and (d) any related site visits, inspections, documentation, or after‑care.
2) Quotes, pricing & taxes

Quotes/estimates are based on visible conditions and information available at the time. Unless stated otherwise, quotes are valid for 30 days and exclude concealed conditions and hazardous materials.

Time‑and‑materials work is billed at our then‑current labour rates, trip/service charges, after‑hours premiums, and material pricing. Minimum charges may apply.

HST (13%) is added to taxable goods and services.

Pricing may be adjusted for material price changes, code‑required scope changes, or customer‑requested changes.
3) Scope, exclusions & change orders

Our Scope of Work is limited to what is described in your written quote, work order, or project contract.

Exclusions commonly include: patching/painting beyond our penetrations; flooring, millwork or landscaping repairs; permits/engineering unless specifically included; asbestos/lead/mould remediation; relocation of utilities; addressing pre‑existing defects; and work by other trades.

Change Orders: Any change to the Scope of Work must be approved in writing (email/text OK) and may adjust price and schedule. Emergency changes may be authorized verbally and documented soon after.
4) Permits, inspections & locates

Unless expressly included, the Customer is responsible for securing permits/inspections and paying related fees. We can assist for an additional fee when requested.

For any ground disturbance, utility locates are required before digging. We will not excavate until valid locates are obtained and markings are visible.

Work is performed to applicable building/plumbing codes and manufacturer installation instructions.
5) Access, site conditions & concealed issues

The Customer will provide safe, timely access to the work area, including clear space, utilities (water/power), and parking. Please secure pets and valuables.

If we discover concealed conditions (e.g., structural issues, deteriorated piping, hidden junctions, asbestos/lead/mould, unsafe wiring, vermiculite, fuel lines), we may stop work and propose a change order or refer to a specialist.

We may refuse or suspend work if site conditions present health/safety risks.
6) Materials, substitutions & owner‑supplied items

We supply new, code‑compliant materials from reputable brands unless otherwise noted. Equivalent substitutions of equal or better quality may be made if a specified item is unavailable.

For owner‑supplied fixtures/appliances, we install on a best‑efforts basis and are not responsible for defects, missing parts, improper sizing, warranty claims, or delays caused by such items. Extra labour/material charges may apply.
7) Warranty
-
Workmanship: We warrant our workmanship for 12 months from substantial completion unless a different period is stated in writing.

Manufacturers’ warranties apply to products and are administered by the manufacturer. We will assist with documentation where reasonable.

Exclusions: misuse/abuse, lack of maintenance, acts of nature, power surges, freezing, vandalism, blockages from foreign objects, pre‑existing defects, and owner‑supplied items, are not or fixtures are not covered. Warranty claims must be reported promptly and allow us reasonable access to inspect and remedy.

Warranty remedies are limited to repair or replacement of the defective workmanship at our discretion. No other warranties, express or implied, are provided except as required by law.
8) Payments, deposits & non-payment

Payment terms are stated on the quote, invoice, or contract. Deposits may be required before scheduling or ordering materials.

Invoices are due upon receipt unless otherwise stated. Late payments may be subject to interest at the maximum rate permitted by Ontario law and/or suspension of work.

The Customer is responsible for all collection costs, including administrative fees, legal fees, and lien-related costs where permitted.

We reserve the right to register a construction lien under the Ontario Construction Act for unpaid balances.
9) Scheduling, delays & force majeure

Project schedules are estimates and may change due to weather, inspections, material availability, site conditions, customer delays, or events beyond our control.

We are not liable for delays caused by force majeure events, including but not limited to extreme weather, labour disruptions, supply-chain interruptions, utility outages, or government actions.
10) Customer responsibilities
-
The Customer confirms they have authority to approve the work and that all information provided is accurate.

The Customer must disclose known hazards, prior repairs, structural issues, or special site requirements before work begins.

Failure to meet Customer responsibilities may result in delays, additional costs, or suspension of work.
11) Safety & compliance
-
We follow applicable Ontario health and safety requirements. The Customer agrees not to interfere with safety procedures.

We may stop work immediately if unsafe conditions arise, without liability, until the issue is resolved.
12) Damage limitation
-
We take reasonable care to protect the property; however, minor cosmetic damage may occur during normal construction activities.

We are not responsible for hidden or fragile items, pre-existing damage, or areas outside our Scope of Work.
13) Limitation of liability
-
To the maximum extent permitted by law, A&B HomeFix’s total liability is limited to the value of the work performed under the applicable contract.

We are not liable for indirect, incidental, consequential, or special damages, including loss of use, loss of income, or loss of profits.
14) Cancellation & termination
-
Cancellations must be made in writing. Deposits are non-refundable once materials are ordered or work is scheduled.

We may terminate or suspend services for non-payment, unsafe conditions, misrepresentation, or breach of these Terms.
15) Photos, marketing & documentation
-
We may take photos or videos of work areas before, during, and after completion for documentation, warranty, or quality purposes.
-
Unless the Customer objects in writing, non-identifying images may be used for marketing or portfolio purposes.
16) Governing law & dispute resolution
-
These Terms are governed by the laws of Ontario, Canada.
-
The parties agree to attempt good-faith resolution before commencing legal action. Venue shall be the courts of Ontario.
17) Severability & entire agreement
-
If any provision is found unenforceable, the remaining provisions remain in full force.
-
These Terms, together with the quote or contract, constitute the entire agreement and supersede prior discussions.
18) Acceptance
-
By approving a quote, signing a work order, booking services, allowing work to begin, or making payment, the Customer confirms acceptance of these Terms & Conditions.
